Sun City Grand CC&Rs Explained
The Amended and Restated Declaration of Covenants, Conditions and Restrictions was recorded with Maricopa County on April 14, 2020. It binds every owner and runs with the land.
Below is a plain English summary of what matters to buyers, with a link to the page in the full document for each section.
What the CC&Rs Do
The CC&Rs are one of five governing documents.
Anyone who buys a lot agrees to follow the CC&Rs, the rules and the design guidelines. Leases must require renters to follow them too.
Sun City Grand Community Association, Inc. runs the community. Each lot has one membership and one equal vote.
The CC&Rs can be amended only by a vote or written consent of two thirds of the members. The Board can change the use restrictions and adopt rules with notice.
The Articles of Incorporation, Bylaws, Rules and Regulations and Residential Design Guidelines work alongside the CC&Rs. All five are on the HOA governing documents page.
What Buyers Should Know
Plain English summaries of the sections buyers ask about most.
The community is age restricted. At least 85 percent of occupied homes must have a resident age 55 or older, a person age 45 to 54 may occupy a home under Board procedures, and no one under 19 may stay overnight more than 90 days in any 365 day period.
Every lot pays the same base assessment, which becomes a lien on the lot if unpaid. The Board cannot raise it more than 15 percent in a year without a majority vote of owners, and special assessments are capped at 5 percent of the budget without a vote.
A one time fee is paid when a lot is conveyed to a new owner. It funds new facilities, programs and capital projects, and it is not less than the current base assessment.
Owners need approval from the architectural review process before changing the outside of a home, planting, painting or adding structures. Interior remodeling generally does not need approval.
The Association maintains common areas and perimeter walls. Owners maintain their lot and home and the sidewalk next to it. Neighbors share the cost of party walls.
Owners near a golf course accept the risks of noise, errant balls, maintenance at sunrise and sunset and pesticides. Views are not guaranteed and private amenities are not covered by the governing documents.
The Rules for Your Home and Lot
Exhibit C lists what is allowed and what is not. These are the questions buyers ask most.

Walls, dog runs, animal pens and fences need architectural approval first.

Pickups of one ton or less with a camper shell up to seven feet tall and vans up to seven feet tall and eighteen feet long used for regular transportation are exempt.
Vehicles belong in garages, carports and driveways, and the Association restricts on street parking as much as possible. Garage doors must stay closed except when entering and leaving.
